Terms of Service

These are the ground rules for shopping at Eveningwren. We have tried to write them the way we would explain them across a garden fence, but they are still a binding agreement, so please give them a proper read.

1. About these terms

These Terms of Service apply whenever you browse the Eveningwren website (the "site") or buy from it. By using the site or placing an order, you accept them. If you would rather not accept them, please do not place an order.

2. The company behind Eveningwren

The site is run by WENCHENG (HONG KONG) CO., LIMITED ("Eveningwren", "we", "our", "us"), whose registered address appears at the foot of this page. You can write to us at info@eveningwren.com, and our customer service email is available 24/7.

3. Who can order

You need to be 18 or older, or the age of legal adulthood where you live, to buy from us. Younger shoppers are welcome to browse, but a parent or guardian has to place the order and agree to these terms for them.

4. Accounts and sign-in

Checking out as a guest is always possible. If you choose to open an account, please give accurate details, keep your password to yourself, and let us know quickly if you suspect anyone else has signed in as you. Anything done through your account is treated as done by you.

5. The tumblers we sell

Every Eveningwren design is printed on the same 20 oz straight-sided stainless steel tumbler with double-wall vacuum insulation, a clear press-in slide lid and a reusable stainless steel straw. The artwork is applied by sublimation and wraps the whole cup in a satin finish. Care instructions are part of the product, and a tumbler that has been through a dishwasher, microwave or freezer may not perform or look as described.

6. Colour and artwork on screen

We photograph each design carefully, yet every phone and monitor shows colour a little differently, so the tumbler in your hand may be a shade warmer or cooler than it looked online. Small shifts in where the artwork meets itself around the cup are part of the printing process and are not faults. Gold and champagne tones in our artwork are printed colour, not metallic leaf or foil.

7. Prices and currency

All prices are listed in U.S. dollars. Shipping is $7.99 flat rate worldwide, and FREE on orders of $100 or more, and it is added at checkout along with any applicable tax. We can change prices whenever we need to, but the price you saw when your order was confirmed is the one you pay. If a price is plainly wrong because of a typing or system error, we may cancel that order and return your money in full.

8. How an order becomes a contract

Placing an order is an offer to buy. The contract between us is formed when we email to say your order has shipped. Before that point we may turn down or cancel an order, for instance if a design has sold out, a payment cannot be confirmed, or something about the order looks fraudulent. If we cancel, you receive a full refund of anything already charged.

9. Paying for your order

Payment is taken at checkout through our payment processor. By paying, you confirm the card or account is yours or that you have permission to use it. Your full card number is never visible to us. Our Payment & Security page has the details.

10. Delivery and when the tumbler becomes yours

We deliver as set out in our Shipping Policy. Delivery windows are good-faith estimates, not promises. The tumbler becomes your responsibility once the carrier delivers it to the address you entered, so please double-check that address before you pay.

11. Returns

You can send an item back within 30 days of delivery, even if you have simply changed your mind. How that works is explained in our Return & Refund Policy, which is part of these terms.

12. Our artwork, name and content

The bird paintings, product photographs, words, layouts and graphics on this site belong to WENCHENG (HONG KONG) CO., LIMITED or the people who license them to us, and copyright and related laws protect them. Owning a tumbler does not give you the right to reproduce, adapt or sell its artwork. Eveningwren is a trademark owned and operated by WENCHENG (HONG KONG) CO., LIMITED. Please do not use the Eveningwren name, logo or look in a way that suggests a connection with us unless we have agreed to it in writing.

13. Using the site fairly

We ask that you do not:

• use the site for anything unlawful, or help someone else do so;
• collect images, text or data from the site with bots, scrapers or similar tools;
• probe, disrupt or overload the site, or introduce viruses or other harmful code;
• pay with someone else's card or account without their permission;
• buy in bulk for resale unless we have agreed to it first;
• send us or post anything misleading, hateful or that infringes another person's rights.

If we see misuse, we may block access or cancel the related orders.

14. Links to other sites

Some links take you elsewhere, for example to a carrier's tracking page or a payment provider's screens. Those sites are run by other companies under their own terms and privacy notices, and we cannot answer for what they contain or how they operate.

15. What we don't promise

We aim to keep the site running smoothly and its information correct, but we cannot guarantee it will be free of interruptions, errors or delays. Apart from what these terms say and the rights the law gives you, the site and its content are offered "as is" and "as available". None of this takes away any consumer protection that the law in your country does not allow us to exclude.

16. Limits on our liability

As far as the law permits, we are not responsible for indirect or consequential loss, lost profits, lost data or similar losses that come from using the site or our tumblers. If we are found responsible for something connected with an order, the most we will pay is what you paid for that order. These limits do not apply to death or personal injury caused by our negligence, to fraud, or to any liability the law says cannot be limited.

17. Your responsibility to us

If you break these terms or the law while using the site and someone brings a claim against us as a result, you agree to reimburse the reasonable costs and losses we face, including sensible legal fees.

18. Law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region. If something goes wrong, please email us before anything else; most problems can be sorted out with a conversation. Any dispute we cannot settle together will be heard by the courts of Hong Kong, without affecting any right you may have to bring a claim in your own country.

19. Updates to these terms

We may revise these terms now and then and will change the "Last updated" date when we do. The version on this page at the time you order is the one that applies to that order; later changes will not reach back to orders already confirmed.

20. If part of these terms fails, and the whole agreement

If a court decides any part of these terms cannot be enforced, the remaining parts still apply. These terms, together with the policies linked from them, make up the complete agreement between you and Eveningwren about the site and your purchases. Choosing not to enforce a right at one moment does not mean we have waived it.
